Strata Plumbing in NSW: Who Pays for What?

The basic rule
Under NSW strata law, the owners corporation looks after common property, and NSW Fair Trading lists plumbing in boundary walls and under floors among those items. Lot owners are generally responsible for fixtures such as baths, toilets, sinks and showers, and for pipes that serve only their lot.
That's a starting point, not a verdict. Your scheme's by-laws, and any common property memorandum it has adopted, can move the line, so they are the first thing to check.
Why leaks are the grey area
Burst pipes, damp and leaking showers are where disputes start, because the cause isn't always obvious. A stain in one unit's ceiling might come from a pipe in the unit above, in the common wall or in a shared stack. Who pays depends on where the fault was, not where the damage appeared, which is why finding the actual source matters.
What a useful plumbing report looks like
If you manage a building or sit on a committee, ask your plumber for a report that includes:
- Photos of the fault and the work done.
- Where the fault was: lot, common property or shared pipe.
- The cause, as far as it can be established.
- Recommendations, and any follow-up work needed.
- An invoice matched to the job and the lot or common property.
Planned maintenance beats emergencies
Many big strata plumbing bills start as small, ignored problems. Typical planned items are drain jetting and camera checks on common lines, hot water system servicing, backflow prevention device testing and, for commercial tenants, grease trap servicing. Which devices need testing depends on the site, so ask what applies to yours.
If there's a dispute
NSW Fair Trading offers free mediation for disagreements between owners and owners corporations. A clear plumber's report that records where the fault was and how it was fixed is useful evidence.
